1. General Description of the Service and the Parties
This electronic transaction service (hereinafter the “Service”) is administered and maintained by the Finland Chamber of Commerce (Business ID 0201469-2), in which ATA Carnet applications are prepared and processed.
The ATA Carnet customs document is subject to a fee payable by the user of the Service (hereinafter the “User”). A User refers to an employee or other operator of an organisation using the Service.
By using the Service, the User undertakes to comply with these Terms of Use (hereinafter the “Terms of Use”). The Terms of Use become binding upon the User upon first registration for the Service.
In addition to these Terms of Use, the User undertakes to comply with applicable Finnish legislation and the ATA Carnet undertaking of the Finland Chamber of Commerce.
2. Obligations of the User
The right to use the Service is granted only to users registered as Users. The User is responsible for their own actions. The right of use is user-specific, and the User may not sell or rent the right of use to third parties. User credentials are personal and must not be disclosed to third parties.
The User undertakes to use the Service in accordance with these Terms of Use and applicable Finnish legislation. The User is responsible for the acquisition, maintenance, operation and use of the devices, software, communication and data connections required to use the Service, as well as for all costs arising from the use of the Service. The User is also responsible for backing up and archiving the materials submitted to the Service. The User’s archiving obligation is based on applicable legislation. The Chambers of Commerce shall not be responsible for the foregoing.
Materials submitted by the User will be available in the Service for two (2) years, after which the data will be deleted or anonymised.
The User is responsible for the content, presentation, accuracy and delivery of all materials sent, submitted or otherwise processed via the Service. The User is also responsible for ensuring that no material processed via the Service infringes copyright or other rights, violates the law or official regulations, or otherwise constitutes misuse of the Service. The User is responsible for all activity conducted via the Service based on the data entered by the User, including any errors or omissions.
The User shall ensure the confidentiality of their user credentials and is responsible for all use of the Service conducted with such credentials, as well as for all resulting costs, fees, obligations and consequences. If the credentials are lost or disclosed to unauthorised parties, the Finland Chamber of Commerce must be notified without delay.
The User is responsible for ensuring that no material containing malware or other features that may interfere with the operation of the Service is introduced into the Service, and that such material is not distributed or otherwise handled in a harmful manner.
The User is obliged to pay all fees arising from the use of the Service against an invoice sent separately.
If the User causes damage to the Finland Chamber of Commerce while using the Service, the User shall be obliged to compensate such damage in full, regardless of whether the damage is direct or indirect.
3. Rights of the User
The User has the right to use the Service solely for the preparation and processing of ATA Carnet applications. The Service may not be used for any other purpose.
The right of use is non-exclusive, non-transferable and non-sublicensable, and may be revoked at any time if the User breaches these Terms of Use or applicable legislation.
4. Rights and Obligations of the Finland Chamber of Commerce
The Chambers of Commerce provide the Service referred to in Section 1. The Chambers of Commerce have the right to amend these Terms of Use, as well as the content and features of the Service, unilaterally and without limitation. The Chambers of Commerce may at any time deny the User access to the Service if the User acts in violation of these Terms of Use.
The Service is provided as it is at any given time and insofar as it is available. The Finland Chamber of Commerce has no obligations other than those expressly set out in these Terms of Use. The Chambers of Commerce may modify the Service, deny access to it or discontinue the Service entirely.
The Finland Chamber of Commerce reserves all rights not expressly granted in these Terms of Use, including, without limitation, ownership, all intellectual property rights and other rights relating to the Service and its components.
The Chambers of Commerce maintain the Service so that it is available to Users on weekdays between 7:00 a.m. and 6:00 p.m. However, uninterrupted or error-free operation or availability of the Service is not guaranteed.
The Chambers of Commerce may suspend the Service and/or its applications due to modification, maintenance or installation work, due to legislation or official regulations, or if the relevant activity or provision of the Service becomes unreasonably difficult. Planned service interruptions will be announced to Users via the Service where possible.
5. Disclaimer
The Finland Chamber of Commerce provides the Service and all related information “as is” and “as available”.
The Finland Chamber of Commerce gives no warranties, express or implied, including but not limited to warranties relating to title, non-infringement, merchantability, fitness for a particular purpose or system compatibility.
The Finland Chamber of Commerce does not guarantee that messages, materials or documents sent via the Service will be delivered.
The Finland Chamber of Commerce shall not be liable to Users or third parties for any direct or indirect damage arising from substantive or technical errors or deficiencies in the Service, or from the use or interpretation of information contained in the Service, regardless of whether such damage results from error, service or network disruptions, maintenance work or any other cause.
The Finland Chamber of Commerce shall not be liable for delays in transaction processes carried out via the Service, nor for loss, damage or misdirection of data or materials causing damage to the User.
6. Limitation of Liability
The liability of the Finland Chamber of Commerce for any damage incurred by the User as a result of the use of the Service shall in all circumstances be limited to a maximum of thirty (30) euros.
This limitation of liability shall apply regardless of whether the User’s claim is based on these Terms of Use, non-contractual liability or otherwise on law, and regardless of whether the possibility of such damage was known or should have been known.
The limitation of liability shall not apply to damage caused intentionally by the Finland Chamber of Commerce.
7. Validity and Amendment of the Terms of Use
These Terms of Use are valid until further notice. The Finland Chamber of Commerce has the right to revise and amend these Terms of Use by notifying the User via the Service or in writing. Amendments shall enter into force once announced in the Service.
By continuing to use the Service, the User accepts the amended Terms of Use as binding. If the User does not wish to be bound by the amended Terms of Use, the User may discontinue use of the Service.
8. Intellectual Property Rights
The content and layout of the Service are protected by copyright. All rights of use, copyrights and other intellectual property rights relating to the Service belong to the Finland Chamber of Commerce or third parties.
The User retains ownership of the material uploaded to the Service, except that the Finland Chamber of Commerce has the right, free of charge, without separate notice and without limitation, to use, copy, delete and otherwise process such material.
If material processed via the Service infringes copyright or other rights, violates the law or these Terms of Use, or may cause damage, the Finland Chamber of Commerce has the right to remove such material.
9. Termination of Use of the Service
The User may discontinue use of the Service at any time without providing a reason.
The Finland Chamber of Commerce may deny access to the Service, either temporarily or permanently, to the User, their authorised persons or another organisation if the User, their authorised person or organisation:
- fails to pay fees arising from the use of the Service;
- acts in violation of these Terms of Use; or
- otherwise causes disruption to the Service or any part thereof.
The Finland Chamber of Commerce shall notify the User separately of the termination. In connection with denial of access, the Finland Chamber of Commerce also has the right to remove material uploaded by the User to the Service.
10. Applicable Law and Dispute Resolution
These Terms of Use shall be governed by Finnish law, excluding its conflict-of-law rules.
Disputes relating to the interpretation or application of these Terms of Use shall primarily be resolved through negotiations.
If no agreement is reached, disputes shall be finally resolved by arbitration in accordance with the Rules for Expedited Arbitration of the Finland Chamber of Commerce. Upon request of a party, the Arbitration Institute of the Finland Chamber of Commerce may decide that the dispute shall instead be resolved under the Arbitration Rules of the Finland Chamber of Commerce, if deemed appropriate considering the value of the dispute, its complexity and other relevant circumstances.
The seat of arbitration shall be Helsinki, and the language shall be Finnish.
11. Miscellaneous Provisions
Severability
If any provision of these Terms of Use becomes invalid or unenforceable due to mandatory law, the provision shall be interpreted so as to achieve as closely as possible its intended effect. The invalidity of any provision shall not affect the validity or enforceability of the remaining provisions.
Technical Requirements
The Service can be used with most commonly used web browsers. Users are advised to update their browser software to the latest available version.
A PDF reader, such as Adobe Reader, is required to open and read PDF files.
Notices
The Chambers of Commerce may send Users service-related notices by email. If the User does not wish to receive such notices, they must inform the regional Chamber of Commerce or the Finland Chamber of Commerce.
Data Protection
The Finland Chamber of Commerce processes personal data related to the Service in accordance with the EU General Data Protection Regulation and the Finnish Data Protection Act. Further information is available in the privacy notice published on the Service website.
